Terms of Service

Last Updated: December 2024

1. Agreement to Terms

By booking a tour with OverJoy Morocco Travel (referred to in these conditions as "we," "us," or "the company"), you will be accepting these conditions on behalf of yourself and all other persons using our services pursuant to a booking made by you. If you do not agree to these terms, please do not use our services.

2. Booking Procedures & Payments

Once you have agreed on the quoted itinerary and price, we will provide a detailed itinerary and invoice with payment details. To confirm your booking, a deposit of 25% of the total tour price is required. The remaining balance must be paid 30 days prior to your tour start date. For bookings made within 30 days of departure, full payment is required at the time of booking.

We accept payments via Visa, MasterCard, PayPal, Wise, and bank transfer. Your booking will be confirmed after we receive the initial deposit and send you a confirmation email.

3. Changes to Your Booking

If you need to make any changes to your booking, please contact us as soon as possible and confirm your request in writing. We will make every effort to accommodate your request at no additional charge, but changes cannot be guaranteed and may incur additional fees depending on the nature of the change and timing. If changes are not possible for whatever reason, you have the option to proceed with your originally booked arrangements or cancel and pay the applicable cancellation charges per our cancellation policy below.

4. Cancellation Policy

Please notify us as soon as possible if you wish to cancel your travel arrangements in writing. Our cancellation policy is as follows:

  • 30+ days before departure: Full refund (no administration fee)
  • 15-29 days before departure: 50% refund
  • 0-14 days before departure: No refund

We strongly recommend purchasing comprehensive travel insurance to protect against unforeseen circumstances that may affect your travel plans.

5. Unforeseen Circumstances

Due to unforeseen circumstances, we reserve the right to cancel or modify your tour or trek. Unforeseen circumstances include but are not limited to natural disasters, severe weather conditions, war or threat of war, terrorist activities, civil unrest, government actions, strikes, or any other circumstances beyond our reasonable control.

If such an event should occur and results in tour cancellation, we will refund any sum you have already paid to us, including the deposit, but we are not liable to pay any additional compensation beyond the refund of payments made to us.

6. Special Requests

Any special requirements that are important to your booking (dietary restrictions, medical conditions, mobility assistance, room preferences, etc.) must be provided to us in writing at the time of booking or as soon as possible thereafter. We will pass this information to our partner vendors to ensure a safe and enjoyable experience for you.

If there are special requests we are unable to meet, we will advise you in writing prior to your departure. While we will make every effort to accommodate your preferences, no compensation will be paid if such requests cannot be fulfilled due to circumstances beyond our control.

7. Travel Insurance

We do not provide travel insurance. It is your full responsibility to obtain appropriate comprehensive travel insurance coverage. We strongly encourage you to have travel insurance to protect against illness, trip cancellation, baggage loss, flight delays, and other unforeseen circumstances that may affect your travel plans.

8. Travel Documentation

You are responsible for ensuring you have valid passports (with at least 6 months validity from your return date) and appropriate visas or entry permissions for Morocco and any other countries you may visit during your tour. It is the sole responsibility of tour participants to ensure that all passport, visa, and health documentation requirements are met prior to the tour departure date.

OverJoy Morocco Travel is not liable for any issues, costs, or consequences arising from inadequate travel documentation.

9. Health and Safety

Clients are responsible for ensuring they are physically and mentally fit to participate in our tours. Please inform us of any medical conditions, medications, or dietary requirements at the time of booking. We reserve the right to refuse service to anyone whose health, behavior, or conduct may impair the safety or enjoyment of the tour for themselves or other participants.

10. Our Responsibility and Liability

We will accept liability should any part of your travel arrangements not be as described in your booking confirmation and not be of a reasonable standard, provided there was fault on our part or that of our vendor partners. In such cases, we will pay reasonable compensation limited to the maximum amount paid to us for that portion of the travel arrangements.

However, we cannot accept liability for any injury, damage, loss, delay, illness, death, or irregularity that may occur during a tour due to circumstances beyond our reasonable control. This includes but is not limited to acts of God, war, terrorism, civil unrest, natural disasters, strikes, or the actions of third-party service providers.

11. Media Release

OverJoy Morocco Travel reserves the right to use photographs or videos taken during tours for promotional purposes on our website, social media, and marketing materials, unless specifically requested otherwise by the client in writing prior to the tour departure.

12. Complaints

In the unlikely event that you are unsatisfied with any aspect of our service during your tour, please immediately contact your guide, driver, or accommodation provider, who will work to resolve the issue immediately. If this is not possible or the matter cannot be resolved on-site, please contact us in writing with full details of the complaint as soon as possible, ideally within 28 days of your return.

We are committed to resolving any legitimate complaints fairly and promptly.

13. Governing Law

These terms and conditions are governed by the laws of Morocco. Any disputes arising from these terms or your booking will be subject to the exclusive jurisdiction of the Moroccan courts.
